Terms & Conditions

These Terms and Conditions govern the contractual relationship between Kerry Wines Limited (“the Company”) and Kerry Wines’ Wine Club members (the “Members”).

The Wine Club and Enrolment

  1. The Kerry Wines’ Wine Club (the “Wine Club”) is a loyalty programme managed and operated by the Company.

  2. The Wine Club is open to any individual aged 18 years or over who has a valid Hong Kong address. Joint accounts or multiple enrolments by any person are not allowed. Membership of the Wine Club (the “Membership”) is not available to corporations or other legal entities. The Company reserves the right to grant or refuse Membership at its sole and absolute discretion.

  3. You may apply for Membership online at www.kerrywines.com (the “Kerry Wines Website”). Membership is free of charge.

  4. A Membership number will be issued to each Member. By enrolling, Members will be deemed to have accepted these Terms and Conditions and the Kerry Wines Website Usage Terms and Conditions (Please click here for our website usage terms and conditions.)

Membership

  1. Membership is non-transferrable and may only be used by the Member.

  2. The Company may amend and/or terminate the Wine Club, its benefits, privileges and/or its other features, including these Terms and Conditions, at any time without prior notice. Any amendments or termination of the Wine Club will be posted on the Kerry Wines Website. Any use of the Wine Club by a Member will be deemed to be acceptance of such amendments to the Wine Club and/or these Terms and Conditions.

  3. The Company reserves the right to terminate or suspend any Membership at its sole and absolute discretion without prior notice. Upon termination, unless otherwise agreed by the Company, all benefits and privileges of the Member shall cease and all unused e-vouchers and other benefits will become void.

  4. In case of any dispute arising in connection with the Wine Club and Membership (including without limitation, validity of Membership and Members’ rights and obligations), the Company retains the right to make the final decision and each Member hereby waives and agrees to release the Company from any and all claims for direct or indirect loss, costs, damages or expenses of any kind whatsoever and howsoever arising out of or in connection with the Wine Club (including without limitation, any refusal to provide any benefits or privileges or use of e-vouchers).

Types of Membership and Membership Benefits

  1. Upon successful enrolment, you will automatically receive Classic Membership.

  2. Classic Members will receive a 5% discount on every single purchase of 6 bottles or more of wine (excluding Grand Cru Classé wines, En Primeur, rare and promotional items) provided the Classic Membership number is quoted at the time of order. The discount will apply on the date you become a Classic Member and for so long as you remain a Classic Member.

  3. Classic Membership is for an initial period of one year from the date you become a Classic Member, and will be automatically renewed for further periods of one year each upon expiry thereof (each a “Membership Period”) unless such Membership is upgraded to Prestige Membership or is otherwise terminated by you or the Company.

  4. Any Classic Member who spends $30,000 or more within a one year period will be automatically upgraded to become a Prestige Member as soon as they have spent $30,000 and can enjoy the benefits and privileges of Prestige Members. Upon such upgrade, the existing Classic Membership Period will end and a new Prestige Membership Period begins.

  5. Prestige Membership is for an initial period of one year from the date you become a Prestige Member. Any Prestige Member with an aggregate cumulative spend of $30,000 or more in the immediately preceding Membership Period (excluding any subsequent cancellation of purchases, redemption of e-vouchers and the purchase of En Primeur items) will be eligible for renewal of the Prestige Membership for a further one year period.

  6. Prestige Members will be entitled to a 5% discount on any purchase of wine (excluding Grand Cru Classé wines, En Primeur, rare and promotional items) provided the Prestige Membership number is quoted at the time of order. The discount will apply on the date you become a Prestige Member and for so long you remain a Prestige Member.

  7. Any Prestige Member with an aggregate cumulative spend of less than $30,000 in the preceding Membership Period will not be eligible for renewal of the Prestige Membership and will automatically revert back to Classic Membership.

  8. Membership discounts are not applicable to En Primeur offerings and redemption of e-vouchers and cannot be used in conjunction with other promotional offers.

  9. E-vouchers may be offered by the Wine Club to its Members from time to time and may be redeemed by Members when purchasing certain products from the Wine Club. E-vouchers are non-negotiable, non-transferable, non-assignable and not redeemable for cash and are void if sold for cash or other consideration, assigned or transferred.

  10. Members who wish to discontinue their Memberships must provide written notice to the Company at which time all benefits and privileges of the Members shall cease and all unused e-vouchers and other benefits will become void.

Privacy Policy and Governing Law

  1. The Company requires Members to provide certain personal data in order to become members of the Wine Club and enjoy Membership benefits. The Company is not responsible for any loss or failure to deliver any Membership benefits or privileges as a result of a Member’s failure to provide the Company with up-to-date information. The Company’s privacy policy (the “Privacy Policy”) can be found on the Kerry Wines Website and is deemed to be incorporated into these Terms and Conditions. All personal information submitted by a Member to the Company will be managed in accordance with the Privacy Policy. Please read our Privacy Policy by clicking here.

  2. These Terms and Conditions and the relationship between the Company and each Member are governed by and shall be construed in accordance with the laws of Hong Kong Special Administrative Region (“Hong Kong”). Each Member agrees to submit to the non-exclusive jurisdiction of the Hong Kong courts.

  3. These Terms and Conditions are written in the English language and may be translated into Chinese.  In the event of any inconsistency between the English version and the Chinese version, the English version shall prevail.
